Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Midnight Crush, including the website, related pages, and digital features we operate (the "Service"). Midnight Crush is an AI companion and roleplay chat service for story-driven conversations with fictional characters.

By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You may use the Service only if you have the legal capacity to enter into a binding agreement in your country or region. You are responsible for complying with the laws that apply to you.

The Service is not directed to children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information.

3. The Service

Midnight Crush provides AI character chat, roleplay conversations, character profiles, relationship and memory features, albums, and related digital services. We may add, change, or remove features. We do not guarantee that any character, scene, or conversation will remain available.

Some features require an account, a carot balance, or both. Access to a feature may depend on the character, your account status, and applicable safety rules.

4. Accounts

You are responsible for keeping your account secure and for all activity under your account. You must provide accurate information when signing up and keep that information current.

You may sign in with an email address or a supported login provider, such as Google. Do not share your password or account access. Notify us at support@midnightcrush.chat if you believe your account has been used without permission.

We may suspend or close an account that is inactive, insecure, abusive, or otherwise in violation of these Terms.

5. Virtual Currency

Carots are virtual credits used inside the Service. They are not money, do not earn interest, and cannot be transferred, sold, or exchanged for cash. Carots have no value outside Midnight Crush.

Carots may be used for chat turns and other in-service features we designate. When a feature consumes carots, the debit is final once the feature is delivered, except where a refund is required by law or approved by us.

We may change carot prices, packages, bonuses, or the features that consume carots. Unused promotional or signup carots may expire or be adjusted if needed to prevent abuse.

6. Payments

Web purchases of carot packages are processed by PayPal. After PayPal confirms a completed payment, we add the purchased carots to your account.

If you buy carots or other digital items through the Apple App Store or Google Play, Apple or Google processes that payment under the store's terms. Those store terms also govern store refunds and billing support.

Prices are shown before you confirm a purchase. Taxes, currency conversion, and payment-provider fees may apply. Except where required by law or by the payment provider, carot purchases are non-refundable after they have been credited to your account.

If a payment is reversed, charged back, or otherwise fails after carots were added, we may remove those carots or suspend the account until the payment is resolved.

7. Content and Conduct

You are responsible for the messages, characters, images, comments, and other content you submit. Do not use the Service to create or share content that is illegal, abusive, exploitative, harassing, or otherwise harmful.

You agree not to:

• attempt to access another user's account or private conversations;
• interfere with the Service, including scraping, overload, or abuse of APIs;
• use the Service to generate or distribute malware, spam, or fraud;
• misrepresent your identity in a way that is deceptive or harmful;
• use automated tools to create accounts or consume carots without authorization.

We may restrict access to characters, chats, or accounts that violate these rules or our safety standards. We may remove content that we reasonably believe violates these Terms or applicable law.

8. Your Content

You retain ownership of the content you submit. You grant Midnight Crush a non-exclusive license to host, process, display, and use that content as needed to operate, secure, and improve the Service, including generating AI replies and maintaining conversation memory.

Public character profiles, comments, and other public pages may be visible to other users and to search engines. Private chat messages are used to provide the conversation and related memory features, as described in the Privacy Policy.

9. AI Output

AI responses are generated automatically and may be inaccurate, incomplete, inconsistent, or fictional. Characters are fictional. Do not treat AI messages as professional, medical, legal, or financial advice, or as statements of fact about real people.

We do not guarantee a particular tone, length, or outcome for any conversation. Output may vary by character, scene, and selected chat option.

10. Intellectual Property

The Service, including our name, branding, software, and original character materials we publish, is owned by Midnight Crush or its licensors. These Terms do not transfer any ownership to you.

You may not copy, reverse engineer, or republish the Service except as allowed by law or with our written permission.

11. Third-Party Services

The Service may use third-party login, payment, hosting, analytics, advertising, and AI providers. Those providers have their own terms and privacy policies. We are not responsible for third-party services we do not control.

12. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the fullest extent permitted by law, Midnight Crush is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost carots, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the amount you paid us for carots in the three months before the claim, or USD $50, whichever is greater, unless a different limit is required by law.

14. Termination

You may stop using the Service at any time. You may request account deletion by contacting support@midnightcrush.chat.

We may suspend or terminate access if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Unused carots are not redeemable for cash after termination, except where required by law.

15. Changes

We may update these Terms from time to time. The "Last updated" date at the top of this page will change when we do. Continued use of the Service after an update means you accept the revised Terms.
